Uniform Commercial Code (UCC)
The purpose of filing a financing statement is to “perfect” an interest in collateral involved in a secured transaction (it is a means by which a lender may protect its right to collateral that a debtor has used to secure a loan).  A financing statement places a lien on personal property.  The Uniform Commercial Code (UCC) was adopted by the Ohio General Assembly in 1961 and became effective in 1962.  Amended Senate Bill 74 passed June 5, 2001 and became effective July 1, 2001, amended the code to read that ONLY REAL ESTATE FILINGS will be processed by the county recorder; all other filings will be processed by the Secretary of State.

FINANCING STATEMENTS

 

EFFECTIVE JULY 1, 2001

 

The following documents will be filed and indexed at the County Recorder’s Office:

 

1 – Real Property Related UCC Filings

            (Fixture filings in the real estate records)

A.     Fee---$12.00 for filing

B.     PLUS $4.00 for each name indexed including

      debtor(s), secured party and all property owners.

 

2 – Amendments to Real Property Related UCCs

            (amendments, continuations, assignments,

            partial releases)

A.     Fee---$12.00 for filing

B.     PLUS $4.00 for each name indexed including

debtor(s), secured party and all property owners

 

3 – Terminations on Real Property Related UCCs

            (filed prior to July 1, 2001 and filed after

            July 1, 2001)

A.     Fee---$12.00 for filing

B.     PLUS $4.00 for each name indexed including

debtor (s), secured party and all property owners

 

4 – Terminations on UCCs NOT related to Real Estate

            (Filed Prior to July 1, 2001)

A.     Fee---$12.00

 

5 – Correction Statement

            (A new type of filing)

            A. Fee---$12.00 for filing

B. PLUS $4.00 for each name indexed including

                 debtor(s), secured party and all property owners

 

6 – Searches

            A. Fee---$20.00

            B. No Finding Fee

            C. Copies $2.00 per page
